Terms of Service

These Terms govern your use of the KiwiShort apps and website (the "Service") operated by Vanta Technologies LLC, a Utah limited liability company, 560 S 100 W St Unit 15, Provo, UT 84601, USA ("we", "us"). By using the Service you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Service.

2. Your account

You may use the Service as a guest or sign in with Apple or Google. You are responsible for activity on your account. We may suspend accounts that abuse the Service, rewards or payments.

3. Content and licence

All series, episodes, images and text on the Service are owned by us or our licensors. We grant you a personal, non-exclusive, non-transferable licence to stream content for private, non-commercial use. You may not download (except where the app offers it), copy, record, redistribute or circumvent any content protection.

4. Coins, reward coins and membership

• Coins are purchased through the App Store or Google Play and are used to unlock episodes. Coins do not expire.
• Reward coins are granted for free through check-ins, tasks and promotions, are valid for the period shown in the app and are used before coins.
• Coin packs may include extra coins shown as a bonus; all coins you receive from a purchase are regular coins and do not expire.
• Special offers (for example a first top-up offer) are available for the time shown in the app. The countdown is real: when it ends the offer is no longer available.
• Invite friends. When a new user enters your invite code within the time shown in the app and watches for the required time, both of you receive the reward coins shown in the app. Rewards are limited per day; self-referrals, fake or duplicate accounts and other abuse are not allowed, and we may withhold or remove rewards obtained that way.
• Membership (VIP) is an auto-renewing subscription. See the Subscription Terms.
• Coins, reward coins and unlocked episodes have no cash value, are not transferable and are non-refundable except where required by law or by the store's refund policy. If a purchase is refunded by Apple or Google, the related coins or membership are removed.

5. Acceptable use

You agree not to: use bots or modified clients; exploit bugs to obtain coins or rewards; reverse-engineer the apps; or use the Service unlawfully.

6. Changes and availability

We may add, remove or change content and features at any time. Content availability may vary by region.

7. Disclaimers and liability

The Service is provided "as is". To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.

8. Termination

You can stop using the Service and delete your account at any time. We may terminate or suspend access for violations of these Terms.

9. Governing law

These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-laws rules. Courts located in Utah County, Utah have jurisdiction, except that if you are a consumer in the EEA, UK or another country whose law gives you the right to sue in your home courts and to the protection of mandatory local consumer law, nothing in these Terms takes away those rights. EU consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

10. EU / UK consumers: right of withdrawal

Coins and memberships are digital content supplied immediately after purchase. By completing a purchase you expressly request immediate supply and acknowledge that you lose your 14-day right of withdrawal once the supply has begun, to the extent permitted by law. Refund requests are handled by Apple or Google under their policies.
